1. Overview
Tomegan Marketing Group LLC (“Tomegan,” “we,” “us” or “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose and safeguard information when you visit www.tomeganmarketing.com, contact us or engage with our professional services.
This policy describes our general practices. Client agreements and service-specific privacy notices may provide additional terms for work we carry out on your behalf. Optional website analytics is subject to your separate consent.
2. Information we collect
Information you provide
We may collect your name, email address, company name, optional phone number, project details and other information you choose to share through our contact form, email or other communications. In a client engagement, we may also receive business contact details, website URLs, content, configuration information and billing information needed to deliver the agreed services.
The public Tomegan website does not provide account registration, accept subscription payments or offer a website-scanning submission tool. Please avoid including passwords, payment-card details or sensitive personal information in the contact form.
Information collected automatically
Website hosting and security providers may process technical information such as IP addresses, browser and device information, requested pages and request timestamps to deliver and protect the website. If you allow optional analytics, the configured analytics service may also collect usage information such as pages visited, referring sources and interactions.
We use a necessary cookie to remember your privacy choices. Optional analytics remains off unless you allow it, as explained in Section 8.
3. Website content data
When we assess or manage a website as part of an authorized client engagement, we may access and process content, metadata, HTML structure, links and configuration information needed for that work. This may include publicly available pages or information provided by you under the engagement.
You are responsible for having the necessary rights, permissions and authority to share websites, URLs and content for analysis or management, and for ensuring that sharing does not violate applicable law, contractual obligations or third-party rights. The scope of access and processing is governed by the applicable client agreement.
4. AI-assisted processing
Tomegan uses tools such as Cora IQ and other AI-assisted services where appropriate to support content intelligence, efficiency and client work. Information processed through a third-party tool is subject to the applicable client agreement, service-specific notice and that provider’s terms and data-handling practices.
Submitting the Tomegan website contact form does not automatically send your message to an AI model for analysis. Before sharing sensitive or confidential material for AI-assisted work, confirm the agreed processing arrangements with us. Cora IQ’s own platform practices are described in its Privacy Policy (opens in a new tab).
5. How we use your information
We use information to respond to inquiries, communicate about projects and support requests, provide and improve our services, and manage client relationships and billing where applicable. We may also use it to understand website usage when you allow analytics, prevent fraud or abuse, protect security and comply with legal obligations.
Where appropriate, we may use aggregated or de-identified insights to improve our services. We do not sell your personal information to third parties.
7. Data retention
We retain personal information for as long as reasonably necessary for the purposes described in this policy, including responding to inquiries, performing services, maintaining business records and meeting legal, contractual or security obligations. Retention periods may vary by the information involved and the applicable client agreement.
You may request deletion subject to legal and other applicable retention requirements. The website’s privacy-choice cookie is configured to expire after 180 days unless you save a new choice. Inquiry emails are subject to our email systems’ and delivery providers’ retention practices.
9. Contact-form delivery
When you submit the “Start the conversation” form, the website validates the request and, when email delivery is configured, uses Resend to email your name, company, email address, optional phone number and project message to the designated Tomegan recipient. The form handler does not copy the submission into a separate lead database or send an automatic confirmation email.
If direct delivery is unavailable, the website may open your email application with the details prepared for you to send. The form uses a hidden spam trap and a timing check. When Cloudflare Turnstile is enabled, a verification token and, where available, your IP address are sent to Cloudflare to check for abuse.
Form emails are subject to Tomegan’s and the relevant email provider’s delivery, security and retention practices.
10. Data security
We use commercially reasonable administrative, technical and organizational safeguards designed to protect information against unauthorized access, alteration, disclosure or destruction. These may include encrypted transmission, access controls and security measures provided by our infrastructure and service providers.
No method of transmission over the internet or electronic storage is completely secure. We cannot guarantee absolute security.
11. Your rights and choices
Depending on your jurisdiction and the circumstances, you may have the right to access personal information we hold about you, correct inaccurate information, request deletion, restrict or object to processing, receive a portable copy of information, or withdraw consent where processing is based on consent. You may also opt out of marketing communications.
To make a request, email Laurie@tomeganmarketing.com. We may need to verify your identity and will respond within the timeframe required by applicable law. Requests may be subject to lawful exceptions and retention obligations.
For website inquiries and our own business records, Tomegan determines the purposes of processing. In client engagements, Tomegan may process information on a client’s behalf under the applicable agreement. Where the client controls the information, we may direct your request to that client or assist them in responding.
12. International users
If you are in the European Economic Area, United Kingdom or another jurisdiction with data-protection laws, you may have additional rights under applicable law, including the right to complain to a supervisory authority. Where applicable, processing may be based on contractual necessity, legitimate interests, legal obligations or your consent.
Information may be transferred to and processed in the United States or other locations where Tomegan or its service providers operate. Where applicable law requires safeguards for an international transfer, the relevant processing arrangements must provide those safeguards.
13. Children’s privacy
Our website and professional services are intended for business audiences and are not directed to individuals under 18. We do not knowingly collect personal information from minors. If we become aware that a minor has provided personal information, we will take appropriate steps to delete it.
14. Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date at the top of this page. We may communicate material changes through the website or another appropriate notice. Where required, we will request consent separately rather than treating continued use as consent to optional processing.
